Violating stay order: HC summons Chattogram’s Third Joint District Judge Sarkar Kabir Uddin
The High Court yesterday summoned Chattogram's Third Joint District Judge Sarkar Kabir Uddin, directing him to appear before it on March 31 for ignoring an HC stay order and continuing trial proceedings of a land-related case.
The HC bench of Justice JBM Hassan and Justice Md Khairul Alam also issued a rule asking Judge Kabir Uddin to explain in four weeks why contempt of court proceedings should not be initiated against him for violating its stay order.
The HC bench issued the summons order and rule following a contempt of court petition against Judge Kabir Uddin filed by one Belal Hossain and a few others.
Deputy Attorney General Tushar Kanti Roy told The Daily Star that four people, including Mahafuzur Rahman from Chattogram's Hathazari area, had filed a declaration suit in connection with a piece of land in Panchlaish area. The case is pending with the court of Judge Sarkar Kabir Uddin.
Belal Hossain and others from Panchlaish area filed another case in connection with the same piece of land, which is also pending with the court of Judge Kabir Uddin, and later filed a petition with the same court to become a party in the case filed by Mahafuzur Rahman and three others. The judge rejected the petition on May 29, 2019.
Belal and others then filed a revision petition with the HC challenging the rejection order, following which the HC on September 2, 2019 stayed the trial proceedings of the declaration case filed by Mahafuzur Rahman and three others.
The copy of the HC's stay order was submitted before the court of Judge Kabir Uddin. However, he continued the trial proceedings of the declaration suit in violation of the HC's stay order, DAG Tushar Kanti said.
Belal Hossain and others then filed the contempt of court petition with the HC against Judge Kabir Uddin.
Lawyer Ansarul Haque appeared for Belal Hossain and others during hearing the contempt of court petition yesterday.
