Court orders legal action against three Rab members

Judge Mohammad Golam Mortuza Mazumder of the Speedy Trial Tribunal-2 acquitted Mostafa Kamal, the lone accused in the case, as the charges brought against him were not proved and issued the order against the Rab members.

They are team leader of Rab-2 Captain Anwarul Islam, Sub-Inspector (SI) Mehedi Hassan, the investigation officer (IO) and Havildar Shawkat Ali, the complainant of the case.

In his order, the judge said that Captain Anwar transgressed his jurisdiction and territorial limits and got Kamal arrested by misuse of power on false allegations of keeping arms and ammunition. On the other hand, Mehedi Hassan did not investigate the case properly and lawfully and Shawkat Ali filed the false case, committing gross violation of law. So the three deserve punishment under law for their improper, unauthorised and illegal acts, the judge said.

According to the prosecution, a team of Rab members led by Captain Anwar raided the house of Kamal, a businessman at Mirpur at about 2:15am on June 6 last year. The team seized a revolver, a light gun and 10 bullets from his residence. Rab filed an arms case against Kamal the same day.

The IO pressed charge against Kamal on June 20 under the Arms Act. After framing charge against the accused, the court recorded statements of nine prosecution witnesses.

After scrutinising the First Information Report (FIR), charge sheet, case docket, statements of witnesses and other relevant documents, the court found that the charges brought against the accused were false and fabricated.
