HC issues rule on DCC

The bench comprising Justice Syed Mohammad Dusthagir Hossain and Justice Mamnoon Rahman passed the order following a writ petition filed by Bangladesh Environmental Lawyers' Association (Bela) challenging the dumping of waste.

The bench issued a rule to explain within four weeks why the impugned no objection letter of Rajuk and the site clearance of Department of Environment (DoE) purporting to allow conversion/use of sub-flood flow zone and agriculture land of Baliarpur and Konda mouzas as waste dumping depot by the DCC shall not be declared illegal.

The rule also asked the government to show cause why it should not be directed to take appropriate measures to protect the flood flow zone of Konda and Baliarpur villages and frame appropriate rules under the Environment Conservation Act and the DCC ordinance prescribing the procedures for waste management.

The respondents are secretaries of ministries of land, LGRD and Cooperatives, environment and forest and housing and public works, DCC mayor, chairman of Rajdhani Unnyan Kartripakkha and director general of DoE.

Advocate Ozair Farooq, assisted by S Rizwana Hasan, Iqbal Kabir and Tanjibul Alam, moved the petition on behalf of Bela.
